The website www.bengalurupets.in (and its associated mobile/web applications, hereinafter referred to as "Bengaluru Pets" or "Platform") is operated and owned by KRP Tech Solutions OPC Private Limited ("Company", "Us", "We", or "Our"), a company incorporated under the laws of India, having its registered corporate desk at Bangalore Development Authority Complex, 3rd Block, BDA Layout, 2nd Stage, Nagarbhavi, Bengaluru, Karnataka 560072.

Please read these Terms of Service carefully before using the Platform. By accessing, browsing, or placing an order on Bengaluru Pets, you signify your unreserved agreement to be bound by these Conditions of Use, Conditions of Sale, Privacy Policy, Shipping Policy, and Return/Refund Policy.

Electronic Record Notice: These Terms constitute an electronic record within the meaning of the Information Technology Act, 2000 and rules made thereunder, as amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Part A: Conditions Relating to Your Use of Bengaluru Pets

1. Your Account & Eligibility

Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Minors (persons under the age of 18 years) are strictly prohibited from purchasing live animals or registering accounts. If you are under 18, you may use the Platform only under the supervision and express consent of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials and restricting unauthorized access to your devices. You agree to accept full responsibility for all activities that occur under your account.

2. E-Platform for Aggregation & Sourcing

You acknowledge and agree that Bengaluru Pets operates as a structured aggregator platform connecting buyers with verified breeders, specialized farms, and logistics handlers. Unless explicitly stated, contracts for live animals involve verified third-party breeding networks. Bengaluru Pets facilitates quality auditing, health screening, secure payment gateway settlement, and specialized live-transit coordination.

3. Website Access & Limited License

Subject to your compliance with these Terms and payment of applicable order fees, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and make personal use of this Platform.

Restrictions: You shall not download (other than page caching), modify, reproduce, duplicate, copy, sell, resale, or exploit any portion of this Platform (including listings, descriptions, images, or pricing) for commercial purposes without express written consent from KRP Tech Solutions OPC Private Limited. You are strictly prohibited from using data mining, robots, AI-training scrapers, or extraction tools on this Platform.

4. User Conduct, Anti-Harassment & Prohibited Content

You must not use the Platform in any manner that causes, or is likely to cause, the Platform or access to it to be interrupted, damaged, or impaired. You understand that you, and not the Company, are solely responsible for all electronic communications and content sent from your device.

You must NOT use the Platform for any of the following:

• Fraudulent purposes, extortion, or in connection with a criminal offense or unlawful activity under the Bharatiya Nyaya Sanhita, 2023 (BNS) or Information Technology Act, 2000.
• To send, upload, or share material that is deceptive, misleading, defamatory, abusive, indecent, invasive of privacy, menacing, or racially/ethnically objectionable.
• To submit synthetically generated, manipulated, or AI-altered media that misrepresents animal identity, health status, pedigree certifications, or regulatory approvals.
• To intimidate, harass, or threaten company personnel, customer support desks, or logistical handlers.

5. Automated IP Logging & Fraud Prevention

To protect platform integrity and operational security, every form submission, chat interaction, and order placement records the user's IP address and browser metadata.

Any submission containing spam, malicious scripts, unauthorized external links, or abusive language will be automatically rejected. The originating IP address may be permanently blocked across all network sites operated by KRP Tech Solutions OPC Private Limited.

6. Reviews, Feedback & Intellectual Property Rights

All content included on the Platform—such as logos, graphics, text, images, visual renders, software code, and database compilations—is the exclusive property of KRP Tech Solutions OPC Private Limited or its content suppliers, protected under Indian and international copyright and trademark laws.

If you post reviews, feedback, or media, you grant the Company a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, publish, and display such content globally across marketing channels.

7. Disclaimer of Warranties & Limitation of Liability

This Platform, all information, content, products, live animal listings, and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, except as explicitly set forth in our official policies.

The Company disclaims all warranties regarding merchantability, fitness for a particular purpose, or uninterrupted access. Under no circumstances shall KRP Tech Solutions OPC Private Limited be liable for any indirect, incidental, punitive, or consequential damages arising from platform usage.

8. Indemnity & Release

You agree to indemnify, defend, and hold harmless KRP Tech Solutions OPC Private Limited, its directors, officers, employees, agents, and affiliates from any third-party claims, demands, liabilities, costs, or penalties (including legal fees) arising out of your breach of these Terms, violation of applicable laws, or infringement of third-party rights.

9. Governing Law & Exclusive Jurisdiction

These Conditions of Use are governed by and construed in accordance with the laws of the Republic of India. You agree to submit to the exclusive jurisdiction of the Courts at Bengaluru, Karnataka, India for any legal proceedings or disputes.

Part B: Conditions of Sale (Between Seller & Customer)

10. The Contract of Sale

Your placement of an order on Bengaluru Pets constitutes an offer to purchase the specified product or live animal. Upon receipt of your order, an automated Order Receipt Acknowledgement will be issued.

Contract Conclusion: The offer is accepted, and a binding contract of sale is concluded, ONLY when the product or live animal is physically dispatched and a formal Dispatch Confirmation (with transit/tracking details) is issued to you.

11. Sourcing, Verification & Live Animal Welfare Checks

All live animal transactions are subject to strict pre-dispatch veterinary screening:

• Age Limit: Animals must be at least 45 days old (or past weaning age).
• Vaccination & Health: Animals must hold a valid vaccination record and a veterinary "Fit-for-Travel" clearance.
• Visual Confirmation: Photos or video footage of the pet will be provided to the buyer prior to final transport dispatch.

12. Order Cancellations & Reserve Rights

• Buyer Cancellations: Requests must be made within 3 hours of payment. The 25% booking advance is non-refundable and is retained as the cancellation fee. Cancellations requested after dispatch or at the doorstep incur a 100% cancellation fee.
• Company Reserve Rights: Bengaluru Pets reserves the absolute right to cancel any order prior to dispatch due to health risks identified during vet checks, logistics unavailability, weather hazards, or pricing errors.
• Full Refund Settlement: If an order is canceled by the Company prior to dispatch, a 100% full refund will be processed. Upon issuance of a full refund, the Company's financial liability is completely discharged and extinguished.

13. Pricing, Payments & Gateway Charges

• Accepted Modes: Net Banking, Credit/Debit Cards, and UPI processed via PCI-DSS compliant gateways (PayU, CCAvenue).
• No 100% COD: Cash on Delivery is strictly unavailable to ensure live animal safety and prevent bogus bookings.
• Gateway Charges: Standard 2% transaction charges applying to cards/net banking are disclosed at checkout. On seller-initiated cancellations, gateway charges are refunded in full.

14. Delivery, Transit Risks & Inspection

• Shipments operate under specialized transit protocols (railways, climate-controlled road transport, or air cargo).
• Timelines are estimates: 5–7 working days for standard landmark and doorstep delivery, and 3–4 working days for express delivery where approved on request. Transit delays due to weather, transport re-routing, or veterinary safety holds do not constitute a breach of contract.
• Customers must inspect the animal upon arrival. Any physical injury or visible defect must be reported within 4 hours with unedited photo/video evidence prior to signing the Delivery Acknowledgment Form.

15. Returns, Health Claims & Refund Settlement

• 7-Day Guarantee: Health claims are strictly restricted to Parvovirus, Rabies, or severe pre-existing genetic conditions verified by an authorized veterinarian on official letterhead with seal and registration number.
• Handfed Chicks: Due to specialized hand-rearing requirements, handfed chicks carry no returns, refunds, or health guarantee once handed over. The 7-Day Guarantee does not apply to this category.
• Excluded Claims: Minor digestive changes (loose stools, vomiting) due to food transitions or travel stress are excluded.
• Refund Timelines: Approved refunds are initiated in 1–2 working days and reflect in 5–7 business days.

16. Prohibition of Intimidation, Extortion & Third-Party Interference

• Bengaluru Pets maintains a strict zero-tolerance policy regarding harassment, verbal abuse, or unlawful intimidation.
• Closed Commercial Matter: An unfulfilled or canceled order where full payment has been refunded or tendered back to the buyer constitutes a fully settled and closed commercial matter.
• Unauthorized Official Influence: Attempting to coerce company staff or demand extra-contractual payouts using third-party designations (including public servants, municipal officers, police personnel, or political figures acting outside statutory authority) is strictly prohibited.
• Legal Recourse: Misuse of official positions or threats of unlawful harm will be documented and reported to appropriate administrative, vigilance, and law enforcement authorities under applicable provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS) and Anti-Corruption frameworks.

17. Contact & Grievance Officer Details

Bengaluru Pets reserves the right to modify these Terms at any time. Continued use of the Platform after such changes constitutes acceptance of the revised Terms.
